E-Sign Disclosure & Consent Agreement

This E-Sign Disclosure and Consent Agreement ("Agreement") applies to all electronic communications, disclosures, notices, and agreements related to your use of Dime’s services ("Services") provided by Dime Omnipayment Engine Limited ("Dime," "we," "us," or "our") across all Caribbean jurisdictions where Dime operates.

Please read this Agreement carefully and retain a copy for your records.

1. Scope of Consent

By agreeing to this E-Sign Disclosure and using Dime’s Services, you consent to receive all communications, agreements, disclosures, notices, and other documents electronically ("Electronic Communications"). These communications may include, but are not limited to:

  • Legal and regulatory disclosures and documents.

  • Terms of service, privacy policies, and updates to these agreements.

  • Transaction records and summaries, including payment confirmations, receipts, and account statements.

  • Notices regarding the status of your account or use of the Services.

  • Any other information or communication we may be required to provide to you under applicable laws and regulations.

This consent applies to all interactions with Dime, including account creation, use of payment services, transactions, and any related activities, regardless of whether you access the Services via a computer, mobile device, or any other electronic method.

2. Legal Framework

This Agreement is governed by electronic signature laws applicable in the Caribbean, including but not limited to:

  • Electronic Transactions Act (where applicable in each Caribbean jurisdiction), governs the legal recognition of electronic signatures and documents.

  • The United Nations Convention on the Use of Electronic Communications in International Contracts (2005), where applicable.

  • E-Sign Act (US law, where relevant), applicable to cross-border transactions involving the United States.

By consenting to this Agreement, you agree that your electronic signature has the same legal effect as a physical, handwritten signature.

3. Hardware and Software Requirements

To access and retain Electronic Communications, you must have the following:

  • A valid email address.

  • A device (computer, smartphone, tablet) with internet access and a supported operating system.

  • The latest version of a web browser that supports 128-bit encryption (e.g., Chrome, Safari, Firefox).

  • Software capable of viewing and saving Portable Document Format (PDF) files.

  • Sufficient storage capacity on your device to download and save documents.

  • Access to a printer, if you wish to print copies of any Electronic Communications.

By providing your consent, you confirm that you have the necessary hardware and software to access and retain these communications.

4. Withdrawing Consent

You may withdraw your consent to receive Electronic Communications at any time by contacting us at [Insert Contact Information]. However, doing so may result in the suspension or termination of your access to Dime’s Services, as certain communications may only be delivered electronically. There are no fees to withdraw consent, but withdrawal does not affect the validity or enforceability of any Electronic Communications provided prior to the withdrawal of consent.

5. Requesting Paper Copies

You may request paper copies of any Electronic Communications at no additional cost by contacting us at [Insert Contact Information]. We will provide paper copies within a reasonable time after receiving your request.

6. Updating Your Contact Information

It is your responsibility to keep your contact information, including your email address, up to date. You can update your information by logging into your account or by contacting Dime directly.

7. Validity and Enforceability

Electronic Communications you receive from Dime under this Agreement shall be considered legally binding and enforceable, in compliance with all applicable electronic signature laws across the Caribbean. Any transaction or agreement executed electronically shall have the same legal effect as if the transaction or agreement were performed with physical documents and handwritten signatures.

8. Amendments to this Agreement

We reserve the right to modify the terms of this Agreement at any time. Any modifications will be effective upon posting the revised Agreement on our website or through other electronic means. We will notify you of any significant changes. By continuing to use Dime’s Services after the changes take effect, you consent to the updated terms.

9. Governing Law

This Agreement is governed by the laws of Jamaica, without regard to its conflict of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

By using Dime’s Services and accepting this E-Sign Disclosure and Consent Agreement, you acknowledge that you can access, receive, and retain Electronic Communications and that your electronic signature is legally binding.
